Second Distribution Group – February 25, 2022

The Court has directed that a portion of the settlement class be sent an initial and partial distribution of proceeds from the Co-op’s dissolution.  Almost 1800 settlement class members were issued and mailed a distribution check of up to $5670 each in mid-December 2021.  Some of those being sent a distribution owed the Co-op TAGS fees, and those fees were subtracted from the amount sent to each such individual. 

In a major victory for the construction industry, the Kentucky Court of Appeals has issued its opinion in Carolyn Breedlove v. Smith Custom Homes, Inc. et al. The opinion addressed a number of issues, including applicability of two statutes of limitation that affect homebuilders’ potential liability for alleged construction defects and/or building code violations, KRS 413.120(13) and KRS 198B.130(2).
